The RTD process is case-by-case, and the timeline depends on how long it takes the employee to complete each required step successfully. No exact duration can be guaranteed, as it varies based on the individual’s compliance with treatment, education, and follow-up requirements. Completing all 6 steps is when the violation is no longer active.
Similar to the Return-to-Duty (RTD) process, the SAP program is case by case. The length of the program depends on how long it takes the employee to complete the recommended treatment and/or education and successfully complete the follow-up evaluation.
After the SAP has completed their role (Steps 1–4), Steps 5 and 6 are managed by your employer or a Third-Party Administrator (TPA) if you are enrolled in one. This includes arranging the Return-to-Duty test and carrying out the required follow-up testing plan, as outlined in 49 CFR Part 40.
